Terms of service
The terms that apply when you use this website or engage Winans Collective Co Pty Ltd.
Last updated: November 2026
1. About these terms
These terms are issued by Winans Collective Co Pty Ltd (ABN 82 703 384 758, ACN 703 384 758) ("we", "us", "our"). They apply to your use of this website and to any services we provide, together with any written proposal or scope we agree with you. If a written proposal conflicts with these terms, the proposal applies to that engagement.
2. Use of this website
The content on this website is general information about our services. It is not tailored advice for your circumstances. We try to keep it accurate and current but do not promise that it is complete or error-free. You must not use this website for any unlawful purpose or in a way that could damage or impair it.
3. Engagements
An engagement begins when you accept a written proposal from us. The proposal sets out the services, deliverables, timing and fees. Changes to scope must be agreed in writing and may affect timing and cost. You agree to provide the information, access and feedback we reasonably need to carry out the work.
4. Fees and payment
Fees are as stated in the accepted proposal. Unless the proposal says otherwise, invoices are payable within 14 days of issue. We may pause work on an engagement while an invoice is overdue, after giving you notice.
5. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). These include guarantees that services will be provided with due care and skill, will be reasonably fit for any purpose you make known to us, and will be supplied within a reasonable time.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot lawfully be excluded.
6. Intellectual property
The content and design of this website belong to us or our licensors. You may view and print it for personal or internal business use, but you may not reproduce it for commercial purposes without our written permission.
For engagements, ownership of deliverables passes to you once the related fees are paid in full, unless the proposal says otherwise. We keep ownership of our pre-existing materials, methods and know-how, and grant you a licence to use any of them included in your deliverables for the purpose of the engagement. You confirm that any material you supply to us may lawfully be used for the work.
7. Limitation of liability
To the extent permitted by law, and subject to section 5, our liability for a failure to comply with a consumer guarantee is limited, at our option, to supplying the services again or paying the cost of having them supplied again, where the law allows us to limit it in this way.
To the extent permitted by law, we are not liable for any indirect or consequential loss, including loss of profit, revenue or data, arising from your use of this website or our services, and our total liability in connection with an engagement is limited to the fees paid for that engagement.
8. Termination
Either party may end an engagement by giving written notice. If an engagement ends, you must pay for work completed and costs reasonably incurred up to the date of termination. Either party may end an engagement immediately by notice if the other party materially breaches these terms and does not fix the breach within 14 days of being asked to. Sections 5, 6 and 7 continue to apply after termination.
9. Governing law
These terms are governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and the courts that may hear appeals from them.
